RIGHT OF WITHDRAWAL
Pursuant to article 52 of the consumer code, as defined below, the Customer has the right to withdraw from the contract, without specifying the reason, within 14 days from the date on which the customer (or his authorized representative at the reception of the Product) takes physical possession of the Product and in case of split delivery, from the day on which the Customer acquires physical possession of the last product.
To exercise the right of withdrawal the Customer must, within the period of 14 days provided in the precedent paragraph:
- Send the withdrawal form GOMMA FIT, duly completed;
- Send by e-mail or traditional mail a communication which highlight the Customer’s intention to exercise the right of withdrawal under article 52 pf the Consumer Code; this communication must contain the following information:
- Indication of the Product for which the client whishes to exercise the right of withdrawal
Within 14 days from the notice of withdrawal (transmitted in accordance with the article 8) the Client must return the Product to the Seller, according to the instructions provided by the Seller at the time of receipt of the notice of withdrawal. The Customer is exclusively responsible for any decrease in the value of the Product resulting from any manipulation of the Product which is not necessary to verify its nature, characteristics and the right operation: therefore, the Customer shall not remove any labels applied to the Product.
The Seller will provide for the full repayment of the sums paid by the Customer, excluding shipping costs and/or the fee charged by the payment platforms used on the website (Paypal, Scalapay, etc.), without undue delay and in any case not over the 14 days from the date on which the Seller was informed of the Customer’s decision to withdraw the article.
The refund will be made by the Seller with the same payment methods used by the Customer for the initial transaction excluding any fees due to the use of this platform, unless otherwise expressly agreed between the parties and provided that the Customer does not incur additional expense for this refund.
The Seller will provide for the full refund of the sums paid by the Customer, excluding shipping costs and/or any discount codes used during the purchase, without undue delay and no later than 14 days from the date on which the Seller has been informed of the Customer’s decision to withdraw from the contract in accordance with the article 8. This refund will be made by the Seller using the same payment methods used by the Customer for the initial transaction, unless otherwise agreement between the parties and provided that the Customer does not incur any additional expenses in connection with such refund.
The Seller may suspend the refund until he receives the returned Product or, if it is received before to such receipt, until Customer provides proof about his return of the Product.
After the product has been shipped, the order can no longer be cancelled or modified. The return of products already shipped must be made in any case in accordance with the procedure provided.
All communications to the Customer relating to the exercise of the right of withdrawal, including, the communication to confirm the receipt of the exercised withdrawal, will be made by e-mail to the e-mail address provided by the Customer in the Order Form or, if it is different, to the e-mail address indicated by the Customer in the notice of withdrawal. Further variations of this address which are not communicated to the Seller will not be opposable to him.
